LETTING AGENTS – MAKE SURE YOU BELONG TO A CURRENT OMBUDSMAN SCHEME

1st October 2014 – all letting agents and managing agents operating in England should have joined an Ombudsman Scheme or ceased trading as requred by the Enterprise and Regulatory Reform Act 2013.

There were 3 schemes to choose from;

6 August 2018 – ‘Ombudsman Services’ are ceasing to be a redress scheme for the purposes of the above Act.

Letting agents who are currently members of the Ombudsman Services scheme MUST make arrangements to join one of the other two schemes before 6 August 2018.

Universal Credit

When cases transfer from live service to full service, there is a requirement for private tenants to have their housing costs verified with a  tenancy agreement (or other proof of rent) and confirmation of residence.

Currently the Live to Full Service transfers begin 3 months after a site goes live with Full Service.  However as Live Service closes 29/03/19 and all claims have to be transferred by then, the window for transfer action will become shorter the later the sites are in the rollout.

The dates below are the dates transfer action will begin in the stated sites

HMO LICENSING REFORMS

Cornwall Council are now in a position to be able to invite applications from landlords who are affected by the mandatory HMO licensing reforms.

In order to ensure that landlords are given the best chance of complying with the licensing requirements ahead of the 1st October deadline Cornwall Council feel the need to make a start now, and will be doing their best to meet the increased demand that licensing will bring.

Failure to licence a licensable property can attract a fine of up to £30,000 or prosecution so Cornwall Council will be making considerable effort to engage with landlords to notify them of these changes.

Applicants that make a valid application before 1st October 2018 will be eligible for an ‘early bird discount’ fee of £999. After the 1st October 2018 the standard fee will be £1150, or £1500 where a property is identified as licensable by the Council but is operating without a licence.

Details on how to make an application can be found on the Cornwall Council Website at www.cornwall.gov.uk/housing/private-sector-housing/house-in-multiple-occupation/ or alternatively the Private Sector Housing Team will post an applicant an application form for completion.

Anyone wanting advice from Cornwall Council should contact Martyn Dymond, you will be required to join the Cornwall Responsible Landlord Scheme – why not, it is free.

If you let any property with five or more unrelated individuals or two or more unrelated households as tenants you MUST have a licence – Yes, even if it is a bungalow!

THREE YEAR TENANCIES – PLEASE SHARE YOUR THOUGHTS IN THIS SURVEY

The government consultation on longer tenancies on the CRLA website has prompted me to get on with a survey I had been intending to send out a few weeks back. So it is now quite a bit longer (Survey Monkey says it can be completed in 16 minutes but not sure how accurate that is).

HOW TO RENT GUIDE – ARE YOU USING THE RIGHT ONE?

The How To Rent Guide was updated on 26 June.  A link to the new version can be found in the Information Sheets For Landlords Page of the Members Area.

Copies of the most recent (at the time) version of the How To Rent Guide should be given with all new tenancies and when a tenancy rolls over to periodic or is renewed.

ROGUE LANDLORD DATABASE STARTS TOMORROW (6 APRIL 2018)

The rogue landlord database promised in the Housing and Planning Act 2016, initially expected to appear last October, is to commence 6 April 2018.

The list, which will only be available to the central Government and local authorities, will include those with relevant criminal convictions (such as stalking, harassment, blackmail, theft, burglary and handling stolen goods) and those who have been issued with banning orders for a range of offences.

The database will be available to central government and local authorities and will list landlords and agents with criminal convictions and those subject to banning orders.

The database will not be available for the general public for any reason.

Landlords and agents on the database will be able to continue operating unless they are the subject of a banning order.

USE YOUR OLD PAPER £10 NOTES WHILE YOU STILL CAN – BEFORE 1 MARCH 2018

Please be aware that the ‘old’ £10 note will cease to be legal tender on 1 March 2018.

After that date only the ‘new’ polymer note can be spent.

Spend them or give them to charity but don’t lose them.

Check your pockets, wallets, purses and savings boxes to make sure you have dug out all the old notes.

Some shops will be giving the old £10 notes in change up to the last minute, you can ask for the new notes but that may not always be possible.

Those people who find the old notes after 1 March will still be able to take them to the bank for exchange.

The How To Rent Guide which MUST be handed to tenants taking out a new tenancy has been updated.  The new Guide has to be used, handing out old guides will not meet your regulatory requirements and could cause problems if relying on a Section 21 Notice in future.

JOB CENTRE UPDATES

The following news came in while I was enjoying a Christmas break:

Helston Jobcentre will close on 5th January 2018, and relocate to Helston Library, Trengrouse Way, Helston.

Newton Abbot Jobcentre will close on 19th January 2018, and relocate to Forde House, Newton Abbot, from 22nd January 2018.  .

Liskeard Jobcentre will close on 9th March 2018, and relocate to Luxtowe House, Liskeard, from 12th March 2018.

We await confirmation of the closure date for Totnes Jobcentre.

The local MP’s has been advised and all staff are fully aware and plans are in place to ensure our customers are fully informed of the change.

REMEMBER TO SPEND YOUR ‘OLD’ £1 COINS

Please be aware that the ‘old’ £1 coin will cease to be legal tender on 15 October 2017.

After that date only the ‘new’ twelve-sided coin can be spent.

Spend them or give them to charity but don’t lose them.

Check those bottles so many of us have to save odd coins and down the back of sofas and chairs.

Some shops will be giving the round £1 coins in change up to the last minute, you can ask for the new coin but that may not be possible.

Those people who find the old coins after 15 October will still be able to take them to the bank for exchange.

Remember only use a Gas Safe Registered fitter or technician.  There are hefty fines for anyone else carrying out this work and possibly for those employing them to do so.
