The Renters Rights Act 2025 – Use of Section 21 Notice or Section 8 Notice BEFORE 1 May 2026

This advice assumes that the correct notice was served before 30 April 2026

  • The period for taking a Notice for Possession to court relies on the date of the Notice serviced, for example Section 21 Notice expires six months from the date of service of the document and Section 8 has a twelve month lifespan.
  • Whatever your reason for serving Notice of whatever type or ground, If you served a Notice before 1 May 2026 then court action must commence by 31 July – a case of ‘use it or lose it’ – no second chances.

  • The period for making a Notice for Possession to court relies on the Notice being served on students in qualifying properties BEFORE 31 May 2026.
  • If your student tenants have not moved out already or not given you written notice of their intention to move out.
  • Court action must commence by 31 July – a case of ‘use it or lose it’ – no second chances.
